AYRVANA is owned & operated by Damerax Cloud Solutions (MSME Registered, Hyderabad, India). AYRVANA is a boutique discovery marketplace and lead-routing platform. We do not manufacture, sell, ship, inspect, certify, or guarantee boutique products. We do not become a party to buyer-seller transactions unless a separate written agreement says otherwise.

1. Acceptance of Terms

By accessing or using AYRVANA, you agree to these Terms, the Privacy Policy, Disclaimer, Seller Terms, AI and Uploaded Content Policy, IP and Takedown Policy, and any additional policies published on the platform.

2. Platform Role

AYRVANA is owned and operated by Damerax Cloud Solutions, an MSME registered entity in Hyderabad, Telangana, India. AYRVANA provides online discovery, catalogue display, inquiry routing, seller subscription tools, and related digital services. Boutique owners, sellers, advertisers, and uploaders remain solely responsible for their products, services, claims, prices, content, images, offers, measurements, delivery commitments, refunds, returns, taxes, licences, and legal compliance.

3. User and Seller Content

All boutique profiles, product listings, images, text, AI-generated visuals, prices, availability, offers, phone numbers, addresses, and service claims may be provided by third-party sellers or users. AYRVANA may moderate, remove, or restrict content, but moderation does not create an endorsement, warranty, or assumption of liability.

4. AI-Generated and Client-Uploaded Images

Some images may be generated, edited, enhanced, or uploaded by sellers or clients using AI or other tools. Such images are for representation, catalogue, moodboard, or discovery purposes only unless expressly confirmed by the boutique. If an image appears to resemble a living person, model, celebrity, influencer, public figure, private person, brand asset, or copyrighted work, the uploader is solely responsible for having all required permissions and rights. AYRVANA does not verify every image for identity, likeness, copyright, trademark, model release, privacy, publicity rights, or deepfake concerns.

5. Prohibited Use

• You must not upload or share unlawful, defamatory, obscene, harassing, misleading, impersonating, privacy-invasive, infringing, or harmful content.
• You must not upload a person's face, likeness, voice, identity, private image, celebrity-style image, or AI-generated lookalike without lawful rights and consent where required.
• You must not misrepresent AI-generated, edited, sample, stock, or reference images as exact finished products.
• You must not infringe copyright, trademark, design rights, publicity rights, privacy rights, or any third-party rights.

6. Marketplace Transactions

Unless specifically stated in writing, all buyer-seller communication, payment, fitting, measurements, customization, fulfilment, exchange, refund, delivery, quality, and dispute handling takes place directly between the buyer and the boutique. AYRVANA is not liable for transaction disputes, product mismatch, non-delivery, delays, loss, damage, sizing issues, colour variation, design variation, or payment issues between users and boutiques.

7. Payments and Subscriptions

Seller subscription payments may be collected through Damerax or an authorised payment gateway. Payment gateway terms, bank charges, taxes, and processing policies may apply. Activation, suspension, renewal, cancellation, and plan benefits are governed by the applicable seller plan and Seller Terms.

8. No Professional Advice

Information on AYRVANA is provided for general marketplace discovery. It is not legal, financial, fashion certification, product safety, tax, or professional advice.

9. Removal, Suspension, and Takedown

AYRVANA may remove, restrict, de-rank, disable, suspend, or edit access to any listing, boutique, account, image, AI content, or page if we believe it may violate law, platform policy, third-party rights, user safety, brand trust, or operational requirements. Rights owners and affected persons may use the IP and Takedown Policy.

10. Limitation of Liability

To the maximum extent permitted by law, AYRVANA, Damerax Cloud Solutions, owners, employees, contractors, partners, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, reputational, business, data, profit, or transaction losses arising from use of the platform, seller content, AI content, third-party links, WhatsApp communication, payment gateways, or boutique transactions.

11. Indemnity

You agree to defend, indemnify, and hold AYRVANA and Damerax Cloud Solutions harmless from claims, losses, complaints, damages, penalties, legal costs, and expenses arising from your content, products, uploads, AI-generated materials, misuse of the platform, breach of these Terms, or violation of any law or third-party rights.

12. Changes

We may update these Terms at any time. Continued use of the platform after publication of changes means you accept the updated Terms.
